COVID-19 Omnibus (Emergency Measures) and Other Acts Amendment Bill 2020

Updated: Sep 29, 2020

We are calling on all Victorian’s to contact their Upper House MP’s to oppose the following proposed amendments to the COVID-19 Omnibus (Emergency Measures) and Other Acts Amendment Bill 2020, by way of email or phone call.

This Bill has already passed the Lower House and is due to come before the Upper House (Legislative Council) when they meet in early to mid October. Please do not be complacent - time is of the essence and we must share our concerns we have regarding this Bill, as soon as possible, and repeatedly if necessary.

You can find further detailed information on all of these points in this document here. Please read to familiarise yourself with the proposed amendments. Knowledge is power. An Omnibus Bill is a legislative tool used to amend lots of acts at the same time. There are many harmless aspects of this Bill such as giving the courts the ability to conduct proceedings via Zoom. However, the additions giving unprecedented powers to untrained people is where the problem lies. These are found in Clause 16, which makes several additions to the Public Health and Wellbeing Act 2008 which:

- seeks to override all other laws and legislation with the exception of the Charter of Human Rights (which is not binding and often ignored), the State Constitution Act 1975, and the laws created by the Bill itself,

- allow untrained and unqualified person's to become authorised officers, and - further allows said authorised officers to detain a person or group's of people indefinitely if they test positive for COVID-19, been in contact with a person diagnosed with COVID-19 or think they may be a high risk for failing to comply with a health directive.

Actions needed:

- Send a personalised email detailing your concerns about the proposed changes to your Upper House MP's in your Electorate. Our friends over at Health Australia Party have created a super easy form for you to complete which will email on your behalf! The form is found at the bottom of this page.

- Bonus points: follow up throughout the week with a phone call to discuss your concerns. You can find their contact information via our detailed support document Call To Action - COVID-19 Omnibus (Emergency Measures) and Other Acts Amendment Bill 2020.
